1. USER INFORMATION

Who is responsible for processing your personal data? ATP ENGINEERING & PACKAGING S.L.U. is the CONTROLLER responsible for processing the USER’s personal data and informs that such data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD). Why do we process your personal data and for what purpose? Depending on the form from which the personal data have been obtained, they will be processed confidentially for the following purposes:
  • In the Contact form:
    • To respond to inquiries or any type of request made through the contact forms on the CONTROLLER’s website. (based on the legitimate interest of the controller, Art. 6.1.f GDPR)
    • To send commercial and advertising communications by e-mail, fax, SMS, MMS, social networks or any other electronic or physical means, present or future, related to the CONTROLLER’s products and services or those of its partners/suppliers with promotional agreements. Under no circumstances will third parties have access to personal data. (based on the data subject’s consent, Art. 6.1.a GDPR)
    • To carry out statistical analyses and market studies. (based on the legitimate interest of the controller, Art. 6.1.f GDPR)
  • In the Curriculum form: To involve the data subject in recruitment processes and analyse the applicant’s profile with the aim of selecting a candidate for the vacant position. (based on the data subject’s consent, Art. 6.1.a GDPR)
  • In the Newsletter form: To send informational bulletins, news, offers, and online promotions. (based on the data subject’s consent, Art. 6.1.a GDPR)
  • In the Ethical or Whistleblowing Channel form: To properly manage the ethical channel by handling reported irregularities, deciding whether to initiate an investigation, with the aim of detecting potential offences, preventing liabilities, and avoiding behaviour contrary to the entity’s internal or external regulations. (for compliance with a legal obligation, Art. 6.1.c GDPR)
  • In the User Registration form: To manage the user’s account in order to provide personalised access to the website and interactive services. (based on the data subject’s consent, Art. 6.1.a GDPR)
How long will we keep your personal data? They will be kept for no longer than is necessary to maintain the purpose of the processing or as long as there are legal requirements determining their retention. When they are no longer needed, they will be deleted using appropriate security measures to ensure anonymisation or complete destruction. Who do we share your personal data with? No disclosure of personal data to third parties is envisaged, except when necessary for the development and execution of the processing purposes, to service providers related to communications, with whom the CONTROLLER has signed confidentiality and data processing agreements as required by current privacy regulations. What are your rights? The rights granted to the USER are:
  • Right to withdraw consent at any time.
  • Right of access, rectification, portability, and erasure of your data, as well as the right to restrict or object to its processing.
  • Right to lodge a complaint with the Supervisory Authority (www.aepd.es) if you consider that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By ticking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact or download forms, USERS expressly, freely, and unequivocally accept that their data are necessary to process their request. The inclusion of data in the remaining fields is voluntary. The USER guarantees that the personal data provided to the CONTROLLER are truthful and is responsible for communicating any modification thereof. The CONTROLLER informs that all data requested through the website are mandatory, as they are necessary to provide an optimal service. If not all data are provided, it cannot be guaranteed that the information and services offered will fully meet the USER’s needs.

3. SECURITY MEASURES

In accordance with current personal data protection regulations, the CONTROLLER complies with all provisions of the GDPR and the LOPDGDD regarding the processing of personal data under its responsibility, applying the principles described in Article 5 of the GDPR: processed lawfully, fairly, and transparently in relation to the data subject, and adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed. The CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established in the GDPR and the LOPDGDD, in order to protect the rights and freedoms of USERS and to provide them with the necessary information to exercise those rights.
